Terms of Service

These terms govern use of the Overwing API, dashboard, and website. By creating an account or making an API call you agree to them.

1. The service

Overwing (“we”, “us”) provides an API that evaluates text you submit against rule sets and returns verdicts, scores, and confidence values (“the Service”). The Service is provided by Overwing (operated by its owner as a sole proprietor). Verdicts are produced by automated models. They are signals to inform your own decisions, not guarantees of safety, accuracy, legality, or fitness for any purpose.

2. Accounts and API keys

You may create an account through the dashboard or through the programmatic signup endpoint. Automated clients and AI agents are welcome to hold accounts and use the Service on the same terms as any other customer, provided a person or legal entity is responsible for the account and its payment.

  • You are responsible for everything done with your API keys. Keep them secret and rotate them if you suspect exposure.
  • You must provide accurate contact and billing information and keep it current.
  • One account per organization is expected. Creating accounts to evade limits or avoid payment is a breach of these terms.
  • You must be at least 18 years old, or the age of majority where you live, to open an account.

3. Acceptable use

You may submit any text you have the right to submit. You may not use the Service to:

  • Violate any law, or infringe anyone’s rights, including privacy and intellectual-property rights.
  • Submit content you are not permitted to share with us and our subprocessors (see the Privacy Policy).
  • Probe, scan, or disrupt the Service, other customers, or our providers, or exceed limits by technical means other than the documented plans.
  • Resell or white-label the Service without our written agreement.

We may suspend or terminate accounts that breach these terms or that present an abuse, fraud, or security risk, with notice where practical.

4. Plans, limits, and payment

Each organization is on a plan with a daily evaluation limit. Current plans and prices are published on the website and at the public plans endpoint. Paid plans are billed monthly in advance through Stripe. Taxes may be added where required.

  • Limits reset at 00:00 UTC. Requests above the limit are rejected and are not billed.
  • You may change or cancel a plan at any time from the dashboard or the API. Changes take effect immediately with proration; cancellations take effect at the end of the current billing period.
  • If a payment fails we will retry it and notify you. If it is not resolved during Stripe’s retry window the organization returns to the free plan.
  • We may change prices with at least 30 days’ notice. Continued use after the change is acceptance of the new price.

5. Your content and our data

You keep all rights to the text you submit and the metadata you attach. You grant us the limited licence needed to process it, store the resulting evaluation, and show it back to you. We keep evaluation records so you can retrieve them; you can request deletion of your organization’s data by contacting us. The Service, its rule sets, documentation, and software are ours or our licensors’ and remain so.

6. Availability and changes

We aim for high availability but the Service is provided “as is” and “as available”. We may change, add, or retire features and endpoints. Where a change is not backward compatible we will document it and, for paid customers, give reasonable notice.

7. Warranties and liability

To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Verdicts can be wrong. You are responsible for how you act on them and for complying with laws that apply to your own product.

To the fullest extent permitted by law, our total liability for all claims relating to the Service in any twelve-month period is limited to the amount you paid us in that period, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.

8. Indemnity

You will defend and indemnify us against claims arising from your content, your use of the Service, or your breach of these terms.

9. Termination

You may close your account at any time. We may terminate or suspend the Service for breach, for legal reasons, or if we discontinue the Service, with reasonable notice where practical. Sections 5, 7, 8, and 10 survive termination.

10. General

These terms are the entire agreement between you and us about the Service. If a provision is unenforceable the rest remains in effect. We may update these terms; material changes will be announced on the website or by email at least 14 days before they take effect. These terms are governed by the laws of the jurisdiction in which the operator is established, and disputes will be resolved in the courts there, without regard to conflict-of-law rules.
